Durham, North Carolina ā June 26, 2026 ā Divers Alert NetworkĀ® (DANĀ®) is aware of public discussion regarding its insurance entity, DAN Risk Retention Group, filing a declaratory judgment action in connection with pending litigation in Texas. The circumstances surrounding the pending litigation involve a tragic loss, and the entire DAN organization extends its sincere concern to all those affected. Out of respect for the family, the parties, our insureds, and the judicial process, we will not comment on the facts of the underlying litigation, the merits of any allegations, litigation strategy, or specific insurance coverage positions beyond the public court record.
However, it is important to distinguish among allegations, legal claims, and judicial rulings. The issue of liability in the underlying litigation and the issue of insurance coverage are two distinct legal matters that will be resolved through the appropriate judicial process. In addition, the filing of a declaratory judgment action should not be interpreted as a statement by DAN that any organization or individual was at fault. Likewise, it should not be interpreted as DAN expressing a view on the quality, adequacy, effectiveness, or efficacy of any training organizationās courses, materials, standards, certification processes, or instructional system. These issues, if raised in the underlying litigation, are part of the litigation process and should be resolved by the courts.
The decision to seek judicial guidance regarding DAN Risk Retention Groupās insurance coverage obligations is separate from any assessment of training standards, educational content, institutional governance, or professional conduct. The DAN organization remains committed to working with training organizations, diving professionals, dive businesses, and industry partners to advance diving safety, responsible risk management, and informed decision-making throughout the diving community. The DAN organizationās role in diving safety, medical information, emergency assistance, research, education, and risk mitigation remains unchanged. We will continue to support the diving public and work with industry partners while respecting the ongoing legal proceedings.
